    • Compliance with applicable laws.

This policy does not apply to complaints regarding content moderation decisions, account suspension or copyright infringement. For these cases, please consult our Appeals Policy or our DMCA Policy.

Interpretation

Unless otherwise indicated, the terms defined in this policy have the same meaning as in our Terms of Use.

Complaints about moderation decisions

We moderate content in accordance with our Terms of Service.
If you wish to appeal the removal of content, suspension of an account, or final warningyou must complete the Content Disablement Appeal Form.

Appeals related to moderated content for suspected illegal activity are handled through our Appeals Policy.

Copyright infringement complaints

If you believe that your content has been copied without authorization, please see our DMCA Withdrawal Policy for more details.

How to file a general complaint?

You may file a complaint in any of the following ways:

  1. Using our Contact FormSelect the reason and describe the problem in detail.
  2. Using the function "Report" directly on the relevant content page.
  3. By sending an email to: support@otakuoshi.com
  4. By sending a postal letter to the registered address of Polaris Nexus LLC.

Be sure to include all relevant information, including Specific URLs if applicable. If essential information is missing, we may not be able to properly investigate your complaint.

How do we handle complaints?

When we receive a complaint:

  • We will review the information provided and any supporting documents.
  • We may request additional information from both the complainant and third parties.
  • We will evaluate the complaint in good faith and within the legally applicable timeframe.
  • If the content clearly violates our Terms of Service, it will be removed.
  • We will notify you once the review is completed and a decision has been made.

If we determine that the content does not violate our policies, you can appeal our decision in accordance with the Appeals Policy.

Abuse of the grievance process

We do not tolerate complaints made in bad faith, for abusive or harassing purposes, or that are intended to harm others.

If you are an OtakuOshi user and you submit an unfounded or abusive complaint, we may suspend or permanently delete your account.

Mediation for consumers in the EU/EEA

If you are located in the European Economic Area, you may - but are not obliged to - use the Online Dispute Resolution (ODR) EU consumer dispute resolution system:

Regulatory complaints under the DSA (EU/EEA)

If you are a resident of the European Union and you consider that OtakuOshi has infringed the provisions of the Digital Services Act (DSA)you have the right to file a complaint with the Digital Services Coordinator of your country.

You may also report directly to us under this Complaint Policy, and appeal any decision under our Appeals Policy.

Regulatory complaints

OtakuOshi is subject to the laws of the U.S. and other jurisdictions in which it operates.
Currently, not regulated by Ofcom (UK) nor for the eSafety Commissioner (Australia). If applicable in the future, users will be notified.

Claims for non-compliance under the Online Safety Act (United Kingdom)

If you are a UK resident, you can bring a claim for breach of contract if you believe that we have:

  • Unfairly removed or restricted access to your content; or
  • Suspended your account without justification according to our Terms of Service.

Your legal rights

This policy does not affect your legal rights as a consumer under applicable laws.
