Infringement Notification Policy and Procedure under the DMCA

Although our website ("Site") has no legal basis in the United States, we respect the intellectual property rights of copyright holdersand have therefore decided to voluntarily comply with the notification and withdrawal provisions set forth in the Digital Millennium Copyright Act ("DMCA").
This site qualifies as a "Service Provider" under 17 U.S.C. § 512(k)(1) of the DMCA, which affords it certain statutory protections known as "safe harbors" from claims of copyright infringement.

Notice of Claimed Infringement

If you believe that your work has been copied and posted on otakuoshi.com in a way that constitutes copyright infringement, please provide the following information to our Designated Copyright Agent:

(a) Electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property right;

Abuse of the Notification Procedure

Misuse of this procedure, or intentional misrepresentation of facts in a DMCA notice or counter-notification, may give rise to liability under 17 U.S.C. § 512(f). This procedure applies only to copyright infringement, no to other disputes, abuses or legal problems.

Withdrawal Procedure

Upon receipt of a valid notification:

The site may quickly remove or disable access to infringing content.
The affected user will be notified.
The user may submit a counter-notification if it considers that the withdrawal was erroneous.
If the claimant fails to file a legal action within a period of 10 to 14 daysThe content can be restored.

Counter-notification under the DMCA

If you received a notice and believe it was incorrect, you may file a counter-notification under sections 512(g)(2) and (3) of the DMCA. This must include:

(a) Specific description of the content that was removed;
(b) Previous location of the content on the Site (exact URLs if possible);
(c) Declaration under oath:
"Under penalty of perjury, I have a good faith belief that the content was removed by mistake or misidentification."
(d) Your physical address, telephone number and e-mail address;
(e) Declaration that you consent to the jurisdiction of the court of competent jurisdiction where you reside, or if outside the U.S., any court where Polaris Nexus LLC operates, and that you will accept legal notice from the original claimant.

Messages in other languages or with non-Latin characters will be considered as invalid.
