Introduction

These Terms of Use govern your use of OtakuOshi and the agreement between you and us. Here are some key points:

• We may modify these Terms at any time.
• If you purchase a subscription, it will automatically renew unless you cancel it.
• Your rights may vary depending on your country of residence.
• If a dispute arises, you agree to notify us and participate in a mediation process before filing a formal complaint.

Interpretations

In these Terms of Service:

• We refer to our platform as "OtakuOshi"accessible from www.otakuoshi.com.
• "We," "our" and "us" refer to. Polaris Nexus LLCthe operating company of OtakuOshi.
• "Commercial User": any user who uses OtakuOshi for commercial purposes (e.g., to monetize content or refer creators).
• "Consumer": non-commercial users.
• "Content": any material uploaded to OtakuOshi (images, text, videos, audio, live streams, emojis, GIFs, etc.).
• "Fan-Creator Contract": the terms that govern each paid interaction between a fan and a creator.
• "Creator": user who publishes content and enables subscriptions or interactions.
• "Maker's earnings": percentage of payment received after deducting applicable fees and taxes.
• "Creator Interaction": subscriptions, paid messages, on-demand content and any other payments between users and creators.
• "Fan": user who registers to view content from creators through some interaction.
• "Fan Payment": any payment made in an interaction with the creator.
• "Indirect Sales Taxes": any tax applied to fan payments according to jurisdiction.
• "Upload": publication, display or uploading of content.
• "Referring User": user who participates in the Referral Program.
• "Subscription": agreement between fan and creator to access their content for a limited time on a recurring payment basis.
• "User": anyone who uses OtakuOshi (whether fan, creator, or both).

Changes in the Terms of Service

We can modify these conditions when:

• Whether necessitated by changes in laws or regulations.
• There are risks to the platform, us, users or third parties.

If the changes significantly affect your use of OtakuOshi, we will notify you so that you can decide whether to close your account before they take effect.

Registration and eligibility

When you register at OtakuOshi:

• You must be at least 18 years old.
• Be legally authorized to accept binding contracts.
• No felony convictions.
• Accept payments related to your interactions in accordance with these Terms.

To create an account Creatoryou must also:

• Verify your identity with a valid document and photos.
• Add a bank account or payment method.
• Configure your subscription fee (if applicable).
• Upload content for your fans.
• Submit any additional information requested.

Content in OtakuOshi

• All the content you upload will be your responsibility.
• You ensure that you own or have a license to use everything you publish.
• If another person appears in your content, you must have their written authorization.
• You agree to act as custodian of records for your content.
• We may remove or restrict content that violates our policies or laws.

Important: Some of the content may include adult material. By accessing, you acknowledge and agree to this possibility.

Subscriptions and interactions

• Subscriptions automatically renew unless you cancel them.
• Prices are set by the creators.
• Payments are processed in USD, and conversion fees may apply.
• You may cancel a subscription, but you will continue to have access until the end of the paid period.
• We reserve the right to suspend accounts in case of abuse, fraud or serious violations.

Payments to creators

• Earnings are transferred after deducting the 20% platform commission.
• Payments are processed through approved third-party vendors.
• You will be able to withdraw your funds once the minimum amount is reached.
• Chargebacks or chargebacks may affect your future income.

Taxes

• Each creator is responsible for file and pay your taxes.
• We may request your tax identification number or other legal information.
• Fiscal non-compliance may result in the suspension of your account.

Responsibilities and limitations

• We do not guarantee that OtakuOshi will always be available without interruption.
• We are not responsible for the content posted by users.
• We reserve the right to remove accounts or content according to our policies.
• If someone infringes your rights (including unauthorized content), you can report it under our Complaint Policy.

Intellectual Property

• You are the owner of your content, but by uploading it you give us a license to use it within the platform.
• We do not sell your content, but we may display or store it as part of the normal operation of OtakuOshi.
• In case of sale of the company, this license could be transferred.

Account deletion

• You can delete your account from the settings.
• If you are a fan, your subscriptions will be cancelled.
• If you are a creator, your account will be closed after all active subscriptions end.
• We may retain certain information in accordance with our Privacy Policy.

Applicable law and disputes

• This agreement is governed by the laws of the country in which you reside, unless local law provides otherwise.
• If you are a user in Europe or the United Kingdom, you can file claims in your jurisdiction.
• If you are a business user, you agree that any dispute will be resolved under the laws of the State of Delaware, USA, and the competent courts in Wilmington.
