Introduction

At Polaris Nexus LLC (“we,” “us,” “our”), we take the privacy and protection of our users’ personal data very seriously. This policy describes how we collect, use, share, and protect your personal information through the OtakuOshi platform (otakuoshi.com and fans.otakuoshi.com), covering all of its users: creators, fans, and content collaborators.

OtakuOshi is a platform that enables content creators to monetize their posts and fans to access and subscribe to that content. By using our services, you agree to the practices described in this policy. This policy is supplemented by the Terms of Service, the Cookie Policy, the Ethics Policy, and the USC 2257 regulations.

Data controller: Polaris Nexus LLC · 1621 Central Ave, Cheyenne, WY 82001, USA · polarisnexuslcc.com · privacidad@otakuoshi.com.

Definition of Personal Data and Age Restriction

Personal data means any information that directly or indirectly identifies an individual, including: first and last name, identity document, photographs and videos, banking and payment details, IP address and location, and voice recordings or facial biometrics. We may also collect anonymized, aggregated, or unlinked data, which is not considered personal data under this policy.

Our services are intended solely for individuals 18 years of age or older. By registering for or using OtakuOshi, you warrant that you are at least that age. If you are not, you are strictly prohibited from accessing, registering for, or using the platform. If we discover that a minor has submitted information or registered, we will suspend their account and delete their data immediately.

Categories of Data Collected

OtakuOshi collects the following categories of personal data depending on the type of user and their interaction with the platform.

🪪

Legal name and alias, physical address and country of residence, government-issued ID with a selfie for verification, email address, phone number, and social media accounts linked to the account. Collected during registration and verification processes.

💳

🔐

Biometric data (verification)

Verification process metadata, face capture via GIF or selfie, and facial recognition data. This data is handled exclusively by vetted providers under contract. OtakuOshi does not directly store biometric data or have access to it.

📥

Third-party data

Information received from identity verification providers, payment processors, fraud prevention services, and, where applicable, public authorities. This data supplements the information provided directly by the user.

Verification and Registration Processes

Creators: before activating a creator account on OtakuOshi, we require proof of legal age (18+) through a government-issued ID and a selfie, confirmation of country of residence to comply with local regulations, banking and tax details to receive payments, and confirmation that the creator has not previously been banned from the platform. For creators who publish R-18 content, verification under the USC 2257 regulations also applies.

Fans: basic registration requires an email address and payment details to access exclusive content. In certain jurisdictions or in cases of suspicious activity, age verification through automated estimation or document validation may be required, as well as information about country of residence for legal restrictions.

Content collaborators: every person who appears in a creator’s content (models, voice actors, etc.) must prove they are at least 18 years old, provide legal documentation, and complete an external verification process if necessary, in accordance with the Ethics Policy and consent requirements.

Third-Party Verification and Facial Biometrics

We use third-party services to carry out age and identity verification. These services may collect selfie-style images and government-issued documents, use facial recognition to verify that the document matches the person, and estimate age (in some countries) using automated technology.

OtakuOshi does not directly store biometric data or have access to it. This data is handled exclusively by vetted providers under contract, subject to confidentiality and security obligations equivalent to those in this policy.

If you choose not to authorize the use of facial recognition, you may need to provide additional documentation for future verifications. Withdrawing consent to the use of biometrics does not affect the lawfulness of processing carried out before the withdrawal.

Use of Data and Legal Basis

We process your personal data for the following purposes, each with its corresponding legal basis:

Creating and managing your account — legal basis: performance of a contract. Verifying identity and age — legal basis: consent and legal obligation. Processing payments and earnings — legal basis: performance of a contract. Moderating content and preventing abuse — legal basis: legitimate interest and legal obligation. Responding to legal and regulatory requests — legal basis: legal obligation. Investigating fraud or suspicious activity — legal basis: legitimate interest. Communicating updates, support, and security information — legal basis: performance of a contract. Complying with tax or identity regulations — legal basis: legal obligation. Preserving evidence in the event of litigation — legal basis: legitimate interest.

We never make automated decisions that significantly affect your rights without human involvement.

How We Obtain and Share Data

How we obtain your data: directly from you (when you register, contact us, or publish content), automatically (through your activity, cookies, IP address, and use of the site), and through third parties (identity verification providers, payment services, authorities).

Who we share your data with: external providers of verification, payment, support, moderation, and tax services; professional advisors (attorneys, accountants, auditors); public authorities in the event of a legal requirement or violation; affiliated companies solely for operational or reorganization purposes; and, in the event of a sale or merger of the business, data may be transferred to the new owner.

We never sell your personal data or use it for behavioral advertising. We do not send direct marketing emails. You will only receive communications related to your account, transactions, or security.

International Data Transfers

Because Polaris Nexus LLC operates internationally, your personal data may be transferred to and processed outside your country of residence, including in the United States, Japan, or other jurisdictions where our providers or related companies operate.

These transfers are carried out under appropriate legal mechanisms: countries with an adequate level of protection recognized by the European Commission, Standard Contractual Clauses (SCCs) approved by the European Commission or their equivalent, and your explicit consent in specific processes where necessary.

You can request more information about these mechanisms by writing to privacidad@otakuoshi.com.

User Rights

Under applicable law (including the GDPR for users in the EU/EEA, the CCPA/CPRA for California residents, and other U.S. state laws), you have the following rights regarding your personal data:

Access: you may request a copy of the data we hold about you. Rectification: you may correct incomplete or inaccurate data. Erasure: you may request the deletion of your data, except where we must retain it for legal or contractual reasons. Restriction of processing: you may ask us to suspend the use of your data in certain circumstances. Portability: you may receive your data in a structured, commonly used, and machine-readable format. Objection: you may object to processing based on legitimate interests. Withdrawal of consent: where processing is based on your consent (for example, facial recognition), you may withdraw it at any time without affecting the lawfulness of prior processing. Complaint to authorities: if you believe your rights have been violated, you may contact your local data protection authority.

How to exercise your rights: send your request to privacidad@otakuoshi.com, clearly stating which right you wish to exercise and providing enough information to verify your identity (the email address associated with your account and, if we require it for security reasons, a partial copy of an identity document). If another person acts on your behalf, they must provide valid legal authorization. You can also update your information directly from your account settings on the platform.

Retention of Personal Data

Your data will be retained only for as long as necessary to: provide you with the services while your account is active, comply with tax, legal, or regulatory obligations (up to 7 years where required by law), and resolve disputes, prevent fraud, or litigate legal claims.

Once these purposes have been fulfilled, the data will be securely deleted or anonymized. Biometric data handled by verification providers is deleted in accordance with those providers’ retention policies, which do not exceed the period necessary to complete the verification.

We do not sell your data: we do not sell or share your personal data with third parties for behavioral advertising based on tracking across websites or platforms.

Sensitive information: OtakuOshi (or its providers) may collect and process data classified as “sensitive information”: username and password, passport or government-issued ID number, part of your credit card number (tokenized), and biometric data (used only by vetted providers). We do not send direct marketing emails.

Third-party links: OtakuOshi may contain links to third-party websites, plugins, or applications. We are not responsible for their privacy policies. We recommend reviewing their terms before providing them with any personal data.

Declining to provide data: to use the platform, you must provide certain information required by law or by the service agreement. If you choose not to provide it, we may be unable to give you full access to OtakuOshi’s features.

Updates to this policy: we may update this policy at any time. If we make material changes, we will notify you in your account or by email. The current version will always be available on this page with the date of the last update.
