OtakuOshi’s compliance statement pursuant to 18 U.S.C. §§ 2257 and 2257A of the United States Code and 28 C.F.R. Part 75. Age verification, records custody, regulated content and exempt content.
Introduction
This website, OtakuOshi.com, is located in and operated from the United States and complies with the requirements set forth in 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75, to the extent required by US federal law.
The USC 2257 regulations require producers of content depicting actual or simulated sexually explicit conduct to maintain records demonstrating that every person appearing in such content was at least 18 years of age at the time of production. This statement explains how OtakuOshi complies with these regulations, which content is subject to them, which content is exempt and where the records are kept.
This statement is supplemented by the Terms of Service, the Privacy Policy, the Ethics Policy and the Publishing Principles.
Content subject to the regulations
All models, actors, actresses and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct contained on this site were 18 years of age or over at the time such visual depictions were produced.
The records required for all depictions of sexually explicit conduct pursuant to 18 U.S.C. § 2257 and 28 C.F.R. § 75 et seq. are on file with the designated Custodian of Records. These records include the age and identity verification documentation for every person who appears in content rated R-18 that depicts sexually explicit conduct.
Exempt content
All other visual depictions displayed on this site are exempt from the provisions of Section 2257 because they meet one or more of the following conditions:
1. They do not portray conduct as specifically described in 18 U.S.C. § 2256(2)(A)(i) through (iv). 2. They do not portray conduct listed in 18 U.S.C. § 2257A and were produced after 19 March 2009. 3. They do not include conduct described in 18 U.S.C. § 2256(2)(A)(v) produced after 19 March 2009. 4. The visual depictions were created prior to 3 July 1995. 5. This company is not a “producer” with respect to the dissemination of such exempt images, as that term is defined in 28 C.F.R. § 75.1(c).
This includes, without limitation: content rated all ages (全年齢), R-15 content (suggestive, without sexually explicit conduct), illustrations, manga, fan art, animation, audio content with no explicit visual component, tutorials, resources and any other content that does not depict actual or simulated sexually explicit conduct involving real people.
Verification process for creators
OtakuOshi applies a verification process that complies with the USC 2257 regulations for all R-18 content depicting sexually explicit conduct.
Identity verification
Every creator who publishes R-18 content involving sexually explicit conduct must complete identity verification: a valid government-issued photo ID (passport, national ID card, driving licence) and a real-time selfie to confirm the match. The process is carried out through a certified third-party provider.
Age verification (18+)
The process confirms that the creator is at least 18 years old. For content in which other people appear (models, actors, collaborators), each of them must be verified individually under the same requirements. No explicit R-18 content is published without full verification of every person who appears in it.
Required documentation
The records include: full legal name, date of birth, a copy of the identification document, any aliases or stage names used, and the date of production of the content. These records are maintained in accordance with the requirements of 28 C.F.R. Part 75 and are kept available for inspection by authorised agents.
Records custody
The records are kept securely by the designated Custodian of Records. OtakuOshi does not publish or share these records with third parties except as required by law or court order. Biometric data from the verification process is handled by the third-party provider and is not stored on OtakuOshi’s servers.
Content collaborators
Every person who appears in an identifiable manner in explicit R-18 content (cosplay models, actors, voice actors in visual content) must be verified before publication. The creator is responsible for ensuring that all participants have completed verification and have given their consent in accordance with the Ethics Policy.
Non-compliance
Publishing explicit R-18 content without full verification of every person who appears in it is a very serious violation that results in immediate removal of the content, permanent suspension of the account, and, where applicable, referral to the competent authorities. There are no exceptions.
Information for creators
If you publish R-18 content on OtakuOshi that depicts sexually explicit conduct (actual or simulated) involving real people, the USC 2257 regulations apply to you directly as a content producer. This means that:
You must be verified before you publish: you will not be able to upload explicit R-18 content until you have completed identity verification. The process begins when you activate your creator account and select the R-18 category.
You must verify everyone who appears: if other people appear in your content (models, actors, collaborators), each of them must be verified individually. You are responsible for ensuring that this verification has been completed before publication.
You must keep records: as a producer, you must maintain records linking each person who appears in your content to their age verification documentation. OtakuOshi facilitates this process through its verification system, but ultimate responsibility rests with the creator.
This requirement does not apply to: illustrations, manga, animation, audio content with no explicit visual component involving real people, fan art, all-ages content or R-15 content. The USC 2257 regulations apply exclusively to visual depictions of sexually explicit conduct involving real people.
Information for fans
To access content rated R-18, fans must pass an age verification process confirming that the user is at least 18 years old. Depending on the jurisdiction, this process may be completed through ID document verification or through automated age estimation.
Fan age verification is a platform requirement that complements creators’ USC 2257 verification. While USC 2257 ensures that the people who appear in the content are adults, fan verification ensures that the people who access the content are adults as well.
Fans’ verification data is handled in accordance with the Privacy Policy. OtakuOshi does not store fans’ biometric data.
