Terms of Service

The legal terms governing the use of OtakuOshi by creators, fans and content collaborators. Eligibility, accounts, content, payments, intellectual property, prohibited conduct, AI policy, liability and dispute resolution.

Acceptance of the Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Polaris Nexus LLC (“OtakuOshi”, “we”, “us”, “our”), located at 1621 Central Ave, Cheyenne, WY 82001, USA, governing access to and use of the OtakuOshi platform, available through otakuoshi.com, fans.otakuoshi.com, otakuoshi.jp, the associated mobile applications, and any service, feature, or content provided through these properties (collectively, the “Platform”).

By creating an account, accessing the Platform, or using any of its services, you agree to be bound by these Terms, the Privacy Policy, the Ethics Policy, the Publishing Principles, the Cookie Policy, and any other policy posted on the Platform (collectively, the “Policies”). If you do not agree to these Terms or any of the Policies, you must not use the Platform.

Effective date: 21 July 2025. Last updated: 21 July 2025.

Eligibility and Account Registration

Minimum age: you must be at least 18 years old to register for, access, or use the Platform. By creating an account, you represent and warrant that you are at least 18 years of age. OtakuOshi reserves the right to verify your age at any time and to immediately suspend or delete your account if it is determined that you are under 18.

Registration: to access the Platform’s features, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at hello@otakuoshi.com.

Account types: the Platform distinguishes between Fan accounts (content consumption, subscriptions, purchases), Creator accounts (publishing and monetising content), and Content Collaborators (individuals who appear in a creator’s content). Creators must complete identity verification before publishing. Creators who publish R-18 content must additionally complete verification under the USC 2257 regulations.

One person, one account: each individual may hold only one account on the Platform, unless expressly authorised. Creating multiple accounts to evade penalties, manipulate metrics, or for any other purpose is grounds for permanent suspension of all accounts involved.

Content: Ownership, Licence, and Responsibility

Rules governing the publication, ownership, and use of content on OtakuOshi.

✍️

Content ownership

Creators retain all intellectual property rights in the content they publish. OtakuOshi does not acquire ownership of your content. By publishing, the creator represents that they are the lawful owner of the rights or have sufficient authorisation to publish and commercialise the content on the Platform.

📜

Licence to OtakuOshi

By publishing content, you grant OtakuOshi a worldwide, non-exclusive, sublicensable, and revocable licence to host, store, display, distribute, and make your content available through the Platform, to the extent necessary to provide the service. This licence terminates when you delete the content, except for temporary backup copies.

👤

Creator responsibility

The creator is solely responsible for the content they publish: its legality, the accuracy of its metadata, its correct rating (all ages, R-15, R-18), obtaining the consent of every person who appears in it, and compliance with third-party intellectual property rights.

🔑

Licence to fans

A fan who purchases or accesses content through a subscription receives a personal, non-transferable, non-exclusive licence to use it. The content is for private viewing and enjoyment. Redistribution, resale, posting on other platforms, modification, and any commercial use without the creator’s express authorisation are prohibited.

🤝

Third-party consent

Every identifiable person appearing in the content (models, voice actors, collaborators) must have given explicit, informed, and verifiable consent in accordance with the Ethics Policy. The creator is responsible for obtaining and documenting such consent before publication.

📋

Ratings and metadata

The creator must correctly rate each piece of content in accordance with the Publishing Principles and provide accurate metadata (format, resolution, language, content, licence). Under-rating adult content and falsifying metadata are serious violations.

Prohibited Conduct

The following is prohibited on OtakuOshi, without limitation:

Content that sexualises minors: the creation, publication, distribution, or storage of any content that sexualises minors, whether real persons or fictional characters with a childlike appearance, regardless of any stated fictional age, is strictly prohibited. Zero tolerance: immediate removal, permanent suspension, and referral to the authorities. See the Ethics Policy.

Non-consensual content: publishing content depicting real persons without their explicit consent, including revenge porn, hidden-camera recordings, leaked intimate content, and any material obtained or distributed without the consent of every person who appears in it.

Deepfakes and identity manipulation: any use of AI, face/body manipulation software, or equivalent techniques to create fake content that simulates the likeness, voice, or performance of a real person without their consent.

Harassment, hate and violence: harassment, bullying, threats, doxxing, stalking, hate speech, discrimination on any basis, incitement to violence, and content depicting real violence against people or animals.

Fraud and deception: impersonation, phishing, scams, deceptive advertising, metric manipulation (fake followers, likes, or comments), evading penalties, and any conduct designed to deceive other users or the Platform.

Unauthorised use: unauthorised access to third-party accounts, reverse engineering of the Platform, exploiting vulnerabilities without following the responsible disclosure protocol, interfering with the operation of the Platform, and any activity that violates applicable law.

Intellectual Property and Derivative Works

OtakuOshi property: the OtakuOshi trademark, logo, Platform design, source code, databases, and all material generated by OtakuOshi are the exclusive property of Polaris Nexus LLC. Their reproduction, modification, or distribution without authorisation is prohibited.

DMCA claims: OtakuOshi respects the intellectual property of others and acts in accordance with the Digital Millennium Copyright Act (DMCA). If you believe your content has been posted on the Platform without your authorisation, you may submit a claim through the DMCA Policy. False or abusive claims may result in suspension of the claimant’s account.

Derivative works (二次創作): OtakuOshi permits the publication of dōjinshi, fan art, and other derivative works within the tradition of Japanese dōjin culture. Creators of derivative works are responsible for respecting the intellectual property of the original rights holders. Derivative works must be clearly identified as such (not as official material), and the creator assumes full responsibility for any claims by the holders of the original rights. OtakuOshi does not act as an intermediary or assume any liability in intellectual property disputes between creators and rights holders.

Artificial Intelligence Policy

AI as author prohibited: it is prohibited to publish on OtakuOshi content generated entirely or predominantly by artificial intelligence while presenting it as a human creation. OtakuOshi is a platform for human creators.

AI as an auxiliary tool: the use of AI tools as part of the creative workflow (upscaling, colour correction, noise removal, writing assistance) is acceptable, provided it is disclosed on the product listing and the content remains fundamentally the work of the human creator.

Deepfakes prohibited: using AI to generate, manipulate, or alter the image, voice, or likeness of real persons without their explicit consent is strictly prohibited.

Scraping and training prohibited: using content published on OtakuOshi to train artificial intelligence models, generative adversarial networks (GANs), diffusion models, or any machine learning system is expressly prohibited. This prohibition applies to users, third parties, bots, scrapers, and any entity that accesses content on the Platform. OtakuOshi reserves the right to take technical measures (blocking, access restrictions) and legal action against anyone who violates this prohibition.

Payments, Subscriptions and Creator Payouts

Fan payments: fans may access content through monthly subscriptions, individual unlock payments, tips, paid messages, and live streams. All prices are displayed in the stated currency before the transaction. Subscriptions renew automatically each period unless the fan cancels before the renewal date. Cancellation stops future renewals but does not entitle the fan to a refund for the current period.

Creator payouts: creators receive their earnings after deduction of the platform fee and payment processing costs. Percentages, payout schedules, minimum withdrawal amounts, and available methods are detailed on the payouts page. OtakuOshi reserves the right to temporarily withhold payments in the event of disputes, chargebacks, suspicious activity, or breach of these Terms.

Refunds: refund requests are evaluated on a case-by-case basis. Downloaded digital products are non-refundable unless the content does not materially match its description. Subscription refunds are governed by the terms of the current period. See the specific terms on the payouts page.

Tax obligations: each user is responsible for complying with their own tax obligations arising from income earned or purchases made on the Platform. OtakuOshi may request tax information (TIN, NIF, VAT, Form W-9) to comply with its reporting obligations under US law and other applicable jurisdictions.

Discreet billing descriptors: charges appear on bank statements under a generic descriptor, with no reference to the Platform’s name or the type of content. More details on the payouts and security pages.

Moderation, Suspension and Termination

Moderation: OtakuOshi reserves the right to review, re-rate, restrict, or remove any content that violates these Terms, the Policies, or applicable law. Moderation decisions are communicated to the affected user with the specific reason in accordance with the Active Response Policy.

Violations and penalties: violations are classified as minor (warning + correction), serious (content removal + formal warning), and very serious (temporary or permanent suspension). Violations involving minors, non-consensual content, and deepfakes are always treated as very serious and result in immediate suspension.

Appeals: users may appeal any moderation action within 20 calendar days by writing to apelaciones@otakuoshi.com with the case ID. A team other than the one that made the original decision reviews the appeal. Appeals are resolved within 10 working days.

Termination by the user: you may close your account at any time from your profile settings or by writing to hello@otakuoshi.com. Closing your account does not extinguish outstanding obligations (payments, refunds, disputes) or data we are legally required to retain.

Termination by OtakuOshi: we reserve the right to suspend or close your account if you breach these Terms, provide false information, engage in conduct that puts other users or the Platform at risk, or if required by a court order or competent authority.

Limitation of Liability and Warranties

“As is” service: the Platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted availability, or freedom from errors.

Third-party content: OtakuOshi is a platform that hosts content from independent creators. We do not control, verify, or take responsibility for the quality, legality, accuracy, or suitability of content published by creators. The commercial relationship is between the creator and the fan; OtakuOshi acts as a technology intermediary.

Limitation of liability: to the maximum extent permitted by applicable law, Polaris Nexus LLC and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Platform, including but not limited to lost profits, loss of data, reputational harm, or business interruption. OtakuOshi’s total aggregate liability to any user shall not exceed the greater of (a) the amounts paid by that user to OtakuOshi in the 12 months preceding the claim or (b) US$100.

Indemnity: you agree to indemnify and hold harmless Polaris Nexus LLC from and against any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising from your use of the Platform, your content, your breach of these Terms, or your violation of the rights of third parties.

Governing Law and Dispute Resolution

Governing law: these Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws rules.

Dispute resolution: before initiating any formal proceeding, both parties agree to attempt to resolve the dispute in good faith through direct negotiation for a period of 30 days from written notice of the dispute. If the dispute is not resolved through negotiation, it shall be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA), seated in Cheyenne, Wyoming. The arbitration shall be conducted in English.

Class action waiver: to the maximum extent permitted by applicable law, you agree that any dispute will be resolved on an individual basis and not as part of a class action, representative action, or consolidated proceeding.

EU/EEA users: nothing in these Terms limits the rights you may have as a consumer under the mandatory laws of your country of residence, including the GDPR, the right of withdrawal, and consumer protection laws. If you reside in the EU/EEA, you may submit disputes to the European Commission’s Online Dispute Resolution (ODR) platform.

Amendments, Notices and General Provisions

Amendments to the Terms: OtakuOshi may amend these Terms at any time. Users will be notified of material changes at least 15 days in advance by email or by a prominent notice on the Platform. Continued use of the Platform after the changes take effect constitutes acceptance of the amended Terms. If you do not agree with the changes, you may close your account before they take effect.

Notices: OtakuOshi’s communications are sent to the email address associated with your account. You are responsible for keeping your email address up to date. Notices are deemed received 24 hours after they are sent.

Assignment: you may not assign or transfer your account or your rights or obligations under these Terms without OtakuOshi’s prior written consent. OtakuOshi may assign these Terms to a successor entity in the event of a merger, acquisition, or sale of assets.

Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that reflects the original intent as closely as possible.

Waiver: OtakuOshi’s failure to exercise, or delay in exercising, any right under these Terms shall not constitute a waiver of that right.

Entire agreement: these Terms, together with the referenced Policies, constitute the entire agreement between you and OtakuOshi regarding the use of the Platform and supersede any prior agreement on the same subject matter.

Contact: for questions about these Terms, write to hello@otakuoshi.com or use the contact page. For privacy matters: privacidad@otakuoshi.com. For complaints: complaints page.
